In order to ensure convenient and understandable shopping, we have prepared the terms of use of this Website and remote shopping, which will be hereinafter referred to as the Distance Contract, and which will outline our mutual remote cooperation.
Distance contract
1. General provisions
1.1. SIA Flowertouch, reg. No. 40203531743, registered office: Zvinu iela 5, Ragaciems, Tukums Municipality, LV-3118, hereinafter referred to as myFlowertouch, sells products or services through the online trading website www.myflowertouch.com, hereinafter referred to as the Website.
1.2. myFlowertouch sells products or provides services, hereinafter also referred to as the Order, in accordance with the provisions set forth in this Distance Contract, in compliance with the legislative requirements of the Republic of Latvia regarding the terms of delivery and return of products, as well as the right of refusal.
2. Consent to provisions
2.1. The person accessing and using the Website confirms that he/she has read these terms and agrees to comply with them without restrictions or conditions.
2.2. myFlowertouch reserves the right to change the terms of the Distance Contract at any time without prior notice. The most current version of the terms is published on the Website at any time. Further viewing and use of the Website after the publication of all changes to the terms of the Distance Contract means your acceptance of these changes without restrictions or conditions.
3. Privacy and data processing
3.1. The Privacy Policy section of the Website explains how myFlowertouch handles your personal data and how data privacy is observed when you use our Website.
3.2. In order to place an Order, you must provide the personal data necessary to accept and fulfil the Order. By using our Website, you confirm that you have read and agree to our privacy policy and that the data you provide is used for myFlowertouch to be able to fulfil the Order in accordance with the requirements of regulatory enactments.
3.3. If the specified data is provided with errors, is false or invalid for the processing of the Order, myFlowertouch may cancel the Order.
3.4. You agree that notifications about the processing and fulfilment of the Order will be sent to the e-mail address you provided, as well as the contact information specified by you will be used for communication with you about the product or service, or delivery changes, to agree on further action. If myFlowertouch fails to contact you, the Order will be cancelled.
4. Information accuracy
4.1. When providing information on available products or services on the Website, myFlowertouch describes and characterises the sold products or services as accurately as possible. If information has changed, it is updated and included on the Website as soon as possible, however myFlowertouch cannot guarantee that the Website is constantly completely updated with the most recent information.
4.2. Product descriptions are informative and the use of the provided information does not create legal obligations between the users of the Website and its creators. The description posted on this Website is only intended for general information, it cannot be used as the sole basis to make decisions.
4.3. myFlowertouch is not responsible for the quality of images of the products – it depends on the technical capabilities of your computer, mobile device and monitor.
4.4. myFlowertouch is not responsible for the compliance of the products or services, their images and other information provided on the Website with your expectations and imagination of the received product or services.
5. Products or services and their prices
5.1. The prices of products or services are specified with VAT and without delivery costs. Delivery costs (VAT inclusive) are specified separately from the price of the product or service after choosing the delivery method.
5.2. Prices of products or services are subject to change without prior notice. The previous price of products or services is kept if the Order has been placed before the change of the price and payment for it has been received in full.
5.3. Products or services may be in limited quantities and their production may be discontinued at any time without prior notice.
6. Delivery and payment procedure
6.1. You have the option to pay for the product by using the payment tools embedded on the Website or by paying the invoice corresponding to the Order, which is prepared by myFlowertouch under request and e-mailed to you. The invoice is prepared electronically and is valid without a signature.
6.2. Order fulfilment is ensured within 1-2 working days when the full payment, including the delivery costs, has been received.
6.3. If the Order is not paid or is paid partially, the Order is cancelled and not fulfilled.
6.4. The Order is processed and shipped on working days.
6.5. Delivery options, countries and costs are described in the Delivery section of the Website.
7. Return of products and right of refusal
7.1. You have the right to unilaterally and without reason refuse the Order within 14 days (calendar days) from the day of receipt of the Order.
7.2. In order for you to use the right of refusal, you must electronically fill out the Refund inquiry located in the Refund policy section of the Website, in which you must indicate the notice about refusing the Order.
7.3. In order to comply with the deadline for the right of refusal, it is sufficient if you send your notice of the exercise of the right of refusal before the expiry of the right of refusal (14 days from the receipt of the Order).
7.4. If you have received damaged product, it does not correspond to the Order, please immediately e-mail a notice to [email protected], sending a photo(s) clearly showing the damage or non-correspondence to the Order, or contact myFlowertouch by using the Contact Form in the Contact section of the Website.
7.5. After notifying of your refusal, in all cases, it is your responsibility to return the product to myFlowertouch to the address specified in the Contact section of the Website. You must send back the products without delay and in any event the returned products must be delivered to myFlowertouch not later than 14 days after you notified us of your decision to withdraw from this contract. The deadline will be complied with if myFlowertouch receives the products before expiry of the 14-day deadline.
7.6. All costs incurred in returning the product, regardless of the reason, are borne by you.
7.7. Refunds for the returned Order, damaged/poor-quality or non-corresponding products will be made using the same payment method you used for the original transaction within 10 (ten) working days of the date of receipt of the returned Order.
7.8. In case of return of products, the delivery fee for the order is not refunded or reimbursed.
7.9. myFlowertouch is entitled to not accept your returned Order if you do not comply with the specified procedure for the return of Products and right of refusal. You are responsible for maintaining the quality and safety of the returned product during the period of exercise of the right of refusal.
7.10. myFlowertouch reserves the right to refuse your exercise of the right of refusal and return the Order price if:
7.10.1. the product is damaged during its use;
7.10.2. the terms of use have not been complied with during the use of the product (terms of use are attached to the product and are also in Useful section of the Website);
7.10.3. original packaging of the product is lost or significantly damaged;
7.10.4. the product is personalised using an engraving service.
8. On copyright, text, pictures, video and other republishing content
8.1. Text, audio and visual (video, photographs) materials available on the myFlowertouch Website may not be partially or fully republished, copied and modified or used in any other way, which is not in accordance with the legal norms of the Republic of Latvia and international legal norms, without agreeing it with myFlowertouch in writing.
9. Force majeure
9.1. myFlowertouch does not undertake the performance of obligations to be carried out or arising due to extraordinary unavoidable circumstances, due to which it is impossible to perform the contractual obligations, resulting in complete losses for the person placing the Order. Force majeure circumstances are those that are beyond myFlowertouch control, could not have been reasonably foreseen and obstacles could not have been avoided or overcome, and these circumstances are such that make the performance of the particular obligation impossible. Force majeure includes, but is not limited to, climate anomalies (floods, earthquakes, storms, etc.), military activities, strikes, government orders, terrorist threats or attacks. Such force majeure circumstances as internet connection disruptions, computer equipment and software interruptions, if there is a possibility to restore the functions of their operation, may delay the performance of contractual obligations for an indefinite period of time.
